These Terms and Conditions ("Terms") govern your access to and use of the TubYard online store and related services. By placing an order, creating an account, or otherwise using our website, you agree to these Terms.

2. Scope and definitions
TubYard sells customizable lanyard products and related components through this website, including configured products (Model 1 and Mobyard lines), spare parts sold in bulk bags, and associated online tools such as the product configurator and Magic Design preview.
- "Consumer" means a natural person acting for purposes outside their trade, business, craft, or profession.
- "Business customer" or "distributor" means a customer purchasing in a professional capacity, including approved TubYard distributors with B2B pricing.
- "Custom product" means any item manufactured or prepared according to your selected colors, quantities, logo, or other configuration submitted at checkout.
3. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into binding contracts. When registering, you must provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account.
We may suspend or close accounts that violate these Terms, abuse our systems, submit fraudulent distributor applications, or attempt to circumvent security or pricing controls.
4. Products and online configurator
Product images, previews, and on-screen renders are illustrative. Slight variations in color, finish, or print placement may occur due to production processes, material batches, and screen settings. Pantone references shown on the site are approximations.
Configured lanyards are made to your submitted specification. Spare parts (Buy Parts) are sold unprinted, in bags of 50 units per reference and color, with a minimum order quantity of 50 units per line; assembly of the final product is your responsibility unless otherwise stated on the product page.
Quantities, unit prices, and available options may depend on your customer type (standard or distributor) and the quantity tier selected at the time of order.
5. Logo upload and intellectual property
If you upload a logo or artwork, you represent and warrant that you own it or have all rights, licences, and permissions needed for TubYard to reproduce it on your order. You indemnify TubYard against claims arising from content you supply.
We may refuse, remove, or cancel orders that appear to infringe third-party rights, violate applicable law, or contain prohibited content (including hate speech, unlawful material, or misleading branding). Uploaded files may be stored for order fulfilment, customer support, and re-order purposes as described in our Privacy Policy.
TUBYARD®, product names, website content, and trade dress are owned by or licensed to TubYard. No licence is granted except as necessary to process your order.
6. Orders, pricing, and payment
Displayed prices are in euros (EUR) unless stated otherwise. Applicable VAT or other taxes are calculated at checkout based on your billing and shipping details and customer status.
For consumers in Portugal, VAT is applied as required by law. Approved distributors with valid business credentials outside Portugal may receive B2B treatment where applicable; you are responsible for providing accurate tax and company information.
An order is an offer to purchase. A contract is formed when we send an order confirmation email or begin processing the order, whichever occurs first. We may decline or cancel orders because of stock limitations, pricing errors, failed payment, suspected fraud, or legal restrictions.
Payment is due through the payment methods offered at checkout. Your order will not be produced until payment is successfully authorised or received, according to the selected payment gateway.
7. Shipping and delivery
We aim to manufacture and dispatch standard configured orders within 24 hours on business days after payment confirmation, subject to order volume, product type, and production capacity. This is a target, not a guaranteed delivery date.
Shipping fees depend on destination country and total units in the order. The shipping cost shown at checkout is calculated from our published matrix (per-unit rate with a minimum charge per destination). Delivery times after dispatch depend on the carrier and destination.
Risk of loss passes to you upon delivery to the address you provide, except where mandatory consumer law provides otherwise.
8. Distributor programme
Business customers may apply to become TubYard distributors through the account area. Approval is discretionary. B2B pricing, VAT treatment, and related conditions apply only after we approve your application and assign the distributor role to your account.
You must submit truthful company details, including legal name, tax number, and contact information. We may request supporting documents and reject or revoke distributor status if information is inaccurate or misuse is detected.
9. Right of withdrawal, returns, and defects
If you are a consumer in the European Union, you generally have a 14-day right of withdrawal for distance contracts, which can be exercised using the cancellation function provided on the website where applicable to your order. However, under Article 16(c) of Directive 2011/83/EU, the withdrawal right does not apply to goods made to your specifications or clearly personalised — including custom-configured lanyards and orders produced with your uploaded logo.
For custom products, please review your configuration carefully before checkout. Once production has started, cancellation may not be possible.
For non-custom spare parts in unopened, resaleable condition, contact us within 14 days of delivery to request a return. Return shipping costs may apply unless the return is due to our error.
The 14-day withdrawal right is separate from your legal guarantee rights, and the exclusion above does not affect your right to receive goods that conform to the contract. Custom products remain fully covered by the legal guarantee of conformity described below; "no withdrawal for change of mind" does not mean "no warranty for defects."
If you receive defective, damaged, or incorrect items, contact us promptly at the support email above with your order number and photos where relevant. As required by EU law, we are liable for any lack of conformity that exists at the time of delivery and becomes apparent within 2 years of delivery. If a defect becomes apparent within the first year, it is presumed to have existed at delivery unless we prove otherwise. Depending on the circumstances, you may be entitled to repair, replacement, a price reduction, or termination of the contract, in line with applicable consumer law. Where mandatory national law in your country of residence provides additional protection, that protection applies.
10. Warranties and limitation of liability
Except as required by mandatory law, TubYard's liability is limited to the amount you paid for the affected order. We are not liable for indirect or consequential loss, loss of profit, or delays caused by carriers, customs, or events outside our reasonable control.
For business customers and distributors, this limitation also excludes liability for business interruption, loss of revenue, loss of anticipated savings, and loss of goodwill, to the maximum extent permitted by law. This paragraph does not reduce any protection mandatorily available to consumers.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
11. Website use and acceptable conduct
You must not interfere with the website, attempt unauthorised access, scrape prices at scale, or use automated means to abuse registration, checkout, or distributor application flows. We implement rate limits and anti-spam measures to protect the service.
12. Privacy
Personal data is processed as described in our Privacy Policy.
13. Changes
We may update these Terms from time to time. The version published on this page applies to new orders from the date of publication. Material changes may also be communicated by email or site notice where appropriate.
14. Governing law and disputes
These Terms are governed by the laws of Portugal, without prejudice to mandatory consumer protections in your country of residence if you are a consumer in the EU.
If you are a consumer, you may bring a complaint to the Portuguese consumer arbitration/ADR bodies, or, if you reside in another EU member state, to the recognised alternative dispute resolution (ADR) body for consumer complaints in your country. A directory of ADR bodies across the EU is available at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies. We are not obliged to participate in alternative dispute resolution before a consumer arbitration body, but we will try to resolve complaints directly when you contact help@tubyard.com.
